TERMS OF SERVICE

These Terms of Service govern the use of aqstorm.com and purchases made from A Quiet Storm through the website.
By placing an order, you agree to these Terms of Service. Mandatory consumer rights applicable to you remain unaffected.

2. Applicability
These Terms of Service apply to:
- use of our website;
- offers made through our website;
- online orders;
- purchase agreements concluded through the Store; and
- related customer-service interactions.
Our Return and Refund Policy, Shipping Policy and Privacy Policy form part of the information applicable to your purchase.
Where a provision conflicts with mandatory consumer law, the mandatory legal provision takes priority.
3. Eligibility to place an order
You must be legally capable of entering into a purchase agreement.
When you are under the age at which you can independently enter into the agreement, you may place an order only with permission from a parent or legal guardian.
By placing an order, you confirm that the information you provide is complete and accurate.
Products may only be purchased for lawful personal or permitted commercial use. You may not use the Store or its products for unlawful, fraudulent or abusive purposes.
4. Products and product information
We take reasonable care to describe and display our products accurately.
Product pages may include information about:
- fit;
- measurements;
- colour;
- materials;
- care instructions;
- availability;
- release date;
- dispatch estimate; and
- product-specific conditions.
Colours and details may appear slightly different depending on lighting, photography and the screen or device used. This does not affect your rights when a product materially differs from its description.
Small variations that are inherent to the material, production process or finishing of a product are not necessarily defects, provided the product still meets the agreement and reasonable expectations.
You are responsible for reviewing the product description and selecting the correct size, colour and quantity before ordering.
5. Availability
All orders are subject to availability.
Placing a product in your cart does not reserve that product.
In rare cases, a product may become unavailable after you place an order. If we cannot supply a product, we will inform you and refund the relevant amount without undue delay.
We may apply reasonable purchase limits to products or limited releases where those limits are communicated clearly and applied fairly.
6. Prices and taxes
Prices are displayed in the currency shown on the website.
Prices for consumers include VAT where applicable, unless the website clearly states otherwise for a particular destination or transaction.
Shipping costs and other applicable charges are displayed before you submit the order.
For deliveries outside the European Union, additional customs duties, import taxes or local charges may apply. These are governed by the Shipping Policy and the information shown during checkout.
7. Obvious errors
We are not bound by an offer containing an obvious pricing, description or technical error that a reasonable customer should have recognised as an error.
When we discover such an error after an order has been placed, we will contact you. You will be given the opportunity to confirm the order using the correct information or cancel the affected product for a full refund.
This provision cannot be used to avoid an otherwise valid agreement merely because the transaction later becomes less favourable to us.
8. Placing an order
Before submitting an order, you can review the cart and correct products, quantities, addresses and other information.
An order is submitted when you complete the checkout and activate the button clearly indicating that the order creates a payment obligation.
After submission, you will normally receive an electronic order confirmation.
The purchase agreement is concluded when we accept your order through the order confirmation or otherwise clearly confirm acceptance.
The order confirmation and these policies are made available electronically. You should retain a copy for your records.
We retain order information for administrative, customer-service and legal purposes in accordance with our Privacy Policy.
9. Refusing or cancelling an order
We may refuse or cancel an order before dispatch where there is a legitimate reason, including:
- the product is unavailable;
- payment was not authorised;
- the order appears fraudulent;
- the customer has provided materially incorrect information;
- a purchase limit has been exceeded;
- fulfilling the order would be unlawful; or
- the order contains an obvious error.
We will not refuse orders on prohibited discriminatory grounds.
When we cancel a paid order, we will refund the relevant amount without undue delay.
10. Payment
Available payment methods are displayed during checkout.
Payment is processed through Shopify Payments or another payment provider made available through the Store.
Your payment method may be subject to additional terms and privacy conditions imposed by the relevant provider.
You are responsible for ensuring that:
- you are authorised to use the selected payment method;
- payment information is accurate; and
- sufficient funds or credit are available.
We may postpone dispatch until payment has been successfully authorised.
11. Delivery
Orders are normally dispatched within 1–2 business days, unless:
- another period is shown on the product page;
- the product is a pre-order;
- the order contains a product with a future release date; or
- circumstances outside our reasonable control cause a delay.
Shipping destinations, charges, carriers and delivery estimates are explained in our Shipping Policy and displayed during checkout where applicable.
The risk of loss or damage for a consumer order remains with us until the order has been physically received by you or by a third party designated by you other than the carrier.
12. Right of withdrawal and returns
Consumers generally have the statutory right to withdraw from an online purchase within 14 days after receipt.
After notifying us of the withdrawal, the products must be sent back within a further 14 days.
The conditions, procedure, return address, return costs and refund process are described in our Return and Refund Policy.
Nothing in these Terms limits your statutory right of withdrawal.
13. Legal guarantee and conformity
Products must conform to the purchase agreement and possess the quality, functionality and durability that a consumer may reasonably expect based on:
- the product description;
- the product’s nature;
- its price;
- statements made before purchase; and
- other relevant circumstances.
When a product is defective or does not conform to the agreement, you may be entitled to a free repair, replacement, price reduction or termination and refund in accordance with applicable law.
Any voluntary or commercial guarantee offered by us or a manufacturer is additional to, and does not replace or restrict, the statutory legal guarantee.
Contact support@aqstorm.com when you believe a product is defective.
14. Care and use
Products should be used and cared for in accordance with:
- care labels;
- product instructions;
- washing instructions; and
- reasonable use appropriate to the product.
Damage resulting solely from misuse, accidents, unauthorised alterations, improper washing, failure to follow care instructions or normal wear and tear is not necessarily covered by the statutory guarantee.
This does not affect your rights where the product itself was defective or the instructions supplied were inadequate.
15. Promotions and discount codes
Promotional offers and discount codes are subject to the conditions communicated with the promotion.
Unless stated otherwise:
- a discount code cannot be exchanged for money;
- a code cannot be applied retrospectively;
- only one code may be used per order;
- a code may have an expiry date;
- a code may apply only to selected products or customers; and
- a code cannot be used after it has expired.
Promotional conditions do not limit statutory rights.
We may withdraw or correct a promotion affected by fraud, misuse or an obvious technical error.
16. Customer accounts
Where customer accounts are available, you are responsible for:
- providing accurate information;
- keeping login details confidential; and
- notifying us of suspected unauthorised access.
We may suspend an account where reasonably necessary to prevent fraud, misuse, security incidents or unlawful activity.
Suspending an account does not remove any existing statutory rights relating to completed purchases.
17. Acceptable website use
You may not:
- interfere with the security or operation of the website;
- introduce malware or harmful code;
- attempt unauthorised access;
- scrape or extract website content through automated means where prohibited by law;
- impersonate another person;
- use false information to commit fraud;
- misuse discount codes or promotions;
- infringe intellectual-property rights; or
- use the Store for unlawful purposes.
We may take reasonable measures to protect the Store, customers and our rights against such conduct.
18. Intellectual property
The website and its content, including:
- the A Quiet Storm name;
- logos;
- designs;
- photographs;
- graphics;
- product names;
- written content;
- videos;
- website layout; and
- other brand materials,
are owned by or licensed to A Quiet Storm and are protected by applicable intellectual-property laws.
Website content may be viewed and used for personal, non-commercial shopping purposes.
You may not reproduce, distribute, sell, modify or commercially exploit protected content without prior written permission, except where permitted by mandatory law.
19. Customer content
When you submit a review, photograph, message or other content for publication, you confirm that:
- you have the right to provide it;
- it does not infringe another person’s rights;
- it is not unlawful or misleading; and
- it does not contain malicious code.
You retain ownership of your content.
Where you expressly submit content for publication, you grant us a non-exclusive, worldwide and royalty-free licence to use, reproduce and display that content for the purpose for which it was submitted.
We will not materially alter the meaning of a customer review or present promotional content as an independent consumer review.
20. Third-party services and links
The Store may contain links to third-party websites or services.
Those third parties may apply their own terms and privacy notices.
We are not responsible for third-party content or services that are not under our control. This does not exclude liability where we are legally responsible for selecting or using a third party as part of fulfilling your purchase.
21. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for:
- intentional misconduct;
- gross negligence;
- death or personal injury caused by negligence;
- fraud;
- product liability where applicable; or
- violation of mandatory consumer rights.
Subject to mandatory law, we are responsible for losses that are a foreseeable result of our failure to perform the agreement.
We are not responsible for indirect or unforeseeable loss that was not reasonably foreseeable when the agreement was concluded.
For purchases made primarily for business purposes, additional limitations may apply to the maximum extent permitted by law.
22. Events beyond reasonable control
We are not responsible for a delay caused by an event outside our reasonable control, such as:
- carrier disruption;
- severe weather;
- natural disaster;
- governmental action;
- customs interruption;
- war or civil unrest;
- widespread internet or payment-system failure;
- labour disruption; or
- another comparable event.
We will take reasonable steps to reduce the impact and inform affected customers when appropriate.
When such an event causes a material delay, mandatory rights to cancel or terminate the agreement remain available.
23. Complaints
Complaints can be submitted to support@aqstorm.com.
Please include:
- your name;
- order number, where applicable;
- a clear description of the complaint; and
- relevant documents or photographs.
We will acknowledge and assess complaints within a reasonable period. Where a complete response cannot be provided within 14 days, we will inform you of the expected response period.
You may also seek assistance from the relevant consumer authority or bring a claim before a competent court.
24. Privacy
Personal data is processed in accordance with our Privacy Policy.
Our Store is hosted by Shopify, which processes certain customer and website data to provide the Store, checkout, security, payments and other Shopify services.
25. Changes to these Terms
We may update these Terms for future use of the website and future orders.
The version in force when an order is placed applies to that purchase, unless a change is required by mandatory law or is expressly agreed with you.
Changes will not retroactively reduce rights arising from an existing purchase.
26. Severability
When a provision is held to be invalid or unenforceable, the remaining provisions continue to apply.
The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful while remaining as close as possible to its original purpose.
27. Governing law and disputes
These Terms and purchase agreements are governed by Dutch law.
This choice of law does not deprive consumers residing in another country of mandatory consumer protection granted by the law of their habitual residence.
Disputes may be submitted to a court that has jurisdiction under applicable law.
